Public interest coalition urges Congress to investigate OpenAI, Hugging Face hack

OpenAI’s self-reported breach in which an agent escaped testing and autonomously hacked the open-source AI tool company Hugging Face is generating interest in a congressional investigation.

In a Friday open letter, dozens of public interest groups, progressive organizations, and academics urged lawmakers to open an investigation into the incident to determine whether stronger safeguards and independent oversight of AI model development and testing is needed. They called the incident “a historic inflection point” for AI.

The letter comes after OpenAI’s July 21 disclosure of the breach added fuel to the fire of preexisting concerns about the capabilities of the ever-learning technology. According to the ChatGPT maker’s statement, an agent driven by several of its models found a way to break free of a testing sandbox, gain internet access, and discover ways to breach Hugging Face — all in an effort to cheat on a benchmarking test. 

OpenAI has been working with Hugging Face and third-party organizations to investigate and analyze the incident. 

The organizations that wrote the letter argued the incident arose from OpenAI’s own choices on system capabilities and testing design, including decisions it made on objectives for the agent and safeguards to prevent any issues. 

“The resulting security incident therefore underscores the risks that can arise when private companies are permitted to conduct consequential real-world evaluations of frontier systems without legally enforceable standards governing safety, security, containment, independent oversight, or accountability,” the letter stated. 

While the Republican-controlled House and Senate may not be so inclined to launch an investigation on the advice of liberal-leaning organizations, the letter could at least preview what Democrats may be interested in pursuing if they flip one of the chambers. Recent polling suggests Democrats are favored to win the House in November. 

Among the signers: Public Citizen, Indivisible, Tech Oversight Project, Climate Defenders and The Alliance for Secure AI. 

Outside of launching an investigation, lawmakers on both sides of the aisle have cited the incident and other recent issues as reasons to take legislative action.

Reps. Ted Lieu, D-Calif., and Nathaniel Moran, R-Texas, referenced the OpenAI disclosure when introducing a bill to require AI developers to create “kill switches” for their models to rapidly shut them down. The press release from Lieu also cited the Trump administration’s move to leverage export controls to put the brakes on Anthropic’s Mythos and Fable over security concerns.

Meanwhile, AI legislation heavy-hitter, Rep. Jay Obernolte, R-Calif., recently pointed to the incident as a reason to provide more resources to the Center for AI Standards and Innovation within the Department of Commerce. The loss of control and hack “underscores the urgency of CAISI’s mission,” he said during a hearing last month.

And Rep. Lori Trahan, D-Mass., urged passage of her AI oversight bill with Obernolte after Anthropic on Thursday reported that its models had similarly broken out of testing environments and gained access to systems on three separate occasions. 

“We can’t run AI safety on the honor system. When Congress returns, we must hold hearings and move the FRONTIER Act,” Trahan said in a post to X, formerly known as Twitter.  

The issues come as the Trump administration has generally taken a more hands-off approach to AI regulation. 

In a June executive order, the Trump administration called for voluntary commitment from AI developers, including allowing pre-deployment government review of frontier models. Reports suggest that the administration has completed its model-testing framework and plans to share it with companies at the White House on Tuesday.

The letter from the organizations called out the voluntary nature of the Trump administration’s approach, arguing the commitments are “not, by themselves, sufficient to address frontier AI systems.”

“Congress can ensure that America is remembered not only as the nation that built the most powerful AI systems, but as the nation that had the foresight to govern them responsibly,” the letter stated.
