DMCA / Copyright Notice
This information is provided for convenience only and does not constitute legal advice. If you have questions about your rights, you should consult a qualified lawyer.
1. Our respect for copyright
PrimeReports.org respects the intellectual property rights of others and expects its users and partners to do the same.
If you believe that material available on or through this Site infringes your copyright or the copyright of someone you are authorised to represent, you may notify us in accordance with this Notice.
2. Scope of this Notice
This Notice applies to claims that content hosted on or linked from PrimeReports.org infringes a valid copyright under applicable law. It is primarily designed to assist rights holders in submitting Digital Millennium Copyright Act ("DMCA")-style notices, but similar principles may apply in other jurisdictions.
Please do not use this process for other types of complaints (for example, privacy, defamation or trademark issues). Those should be raised using our regular contact channels.
3. Before you submit a copyright complaint
Before sending a takedown notice, please consider whether any of the following apply:
- The use may be permitted under an exception or limitation to copyright (such as fair use, fair dealing, quotation, news reporting, commentary or criticism).
- You previously granted permission, a licence or consent for the use of the material.
- The material is not substantially similar to your work or is independently created.
Submitting false or misleading claims of infringement may have legal consequences. If you are unsure whether a use is infringing, you should seek legal advice before submitting a notice.
4. How to submit a copyright / DMCA notice
If you believe that your copyrighted work has been copied and is accessible on this Site in a way that constitutes copyright infringement, please send us a written notice that includes the following information:
4.1 Required information
- Your full name and contact details (including email address).
- Identification of the copyrighted work you claim has been infringed, or, if multiple works are covered, a representative list of such works.
- The exact URL(s) or a clear description of the location of the allegedly infringing material on our Site.
- A statement that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorised to act on behalf of the copyright owner.
- Your physical or electronic signature (typing your full name at the end of the notice may be sufficient for electronic submissions).
4.2 Where to send your notice
You can send your copyright / DMCA notice to:
DMCA / Copyright Agent
PrimeReports.org
Email:
dmca@primereports.org
We prefer notices by email so that we can process them more quickly.
5. What happens after we receive a notice
Once we receive a valid copyright / DMCA notice, we will review it in good faith. Our response may include one or more of the following actions:
- Temporarily or permanently remove or disable access to the allegedly infringing material.
- Contact the user or contributor who posted the material and inform them of the complaint.
- Request additional information from the complaining party if the notice is incomplete or unclear.
We will make a reasonable effort to handle notices promptly, but we cannot guarantee a specific response time.
6. Counter-notifications (if you believe a removal was a mistake)
If your content has been removed or disabled as a result of a copyright complaint and you believe this was a mistake or that you are authorised to use the material, you may send us a counter-notification.
Your counter-notification should include:
- Your full name and contact details (including email address).
- Identification of the material that has been removed or to which access has been disabled, and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the relevant courts for your address (or, if you are outside that country, that you consent to the jurisdiction of an appropriate court where Prime Reports may be found).
- Your physical or electronic signature.
We will review your counter-notification and, where appropriate, may restore the content, subject to applicable law and any legal obligations we may have towards the complaining party.
7. Repeat infringers
Where we have reasonable grounds to believe that a user is a repeat infringer of copyright, we may, in appropriate circumstances and at our discretion, suspend or terminate that user’s ability to contribute content to the Site.
8. No legal advice
Nothing on this page or elsewhere on the Site is intended as legal advice. Copyright law is complex and may vary depending on your country or region. If you are unsure about your rights or obligations, you should seek advice from a qualified legal professional.
9. Updates to this Notice
We may update this DMCA / Copyright Notice from time to time to reflect changes in our practices or in applicable law.
When we make changes, we will update the "Last updated" date at the top of this page. We encourage you to review this Notice periodically.
