Three firms have agreed to settle a class action lawsuit filed over accusations that sensitive user data was shared with third-party companies without consent.

According to the newly updated settlement administrator portal, the period and ovulation tracker app Flo Health allegedly shared users’ menstruation and/or pregnancy data with third-party firms after incorporating software development kits (SDKs) provided by Flurry, Meta and Google.

The plaintiffs claim that the practice is against the law and violates Flo Health’s privacy policy, which states that it will not “transmit any of your personal data to third parties… unless we have asked for your explicit consent.”

Google has agreed to pay $48 million, Flo $8 million and Flurry $3.5 million for a total of $59.5 million.

The settlement fund will be distributed to users who file a claim on a pro-rata basis after paying expenses, such as administration costs, service awards, taxes and litigation expenses. Eligible claimants are users whose data was allegedly shared with third-party firms.

“Unless you are excluded, you are a member of the nationwide Class if you used the Flo App in the United States between November 1, 2016 and February 28, 2019; and you entered menstruation and/or pregnancy information into the Flo App during that time.

Unless you are excluded, you are a member of the California Subclass if you used the Flo App in California between November 1, 2016 and February 28, 2019; you lived in California during that time; and you entered menstruation and/or pregnancy information into the Flo App during that time.”

You can use this portal to file a claim by October 15th.

The three tech firms deny any and all allegations and say they agreed to a settlement to “eliminate the uncertainties, burden, expense, and delay of further protracted litigation.”

The final settlement approval hearing is scheduled for October 29th.
